Most people formally employed in South Africa fall under the Compensation Fund. However, the following groups are not covered by the fund:

  • Workers employed outside of South Africa for more than 12 months without a formal agreement with the Director-General

Employer Responsibility

  • Report an occupational disease within 14 days

  • The employee was off work for 3 days or less (these may fall under sick leave or medical aid cover)

Types of Compensation Offered

Depending on the severity of the injury or illness, compensation is available in the form of:

  • Temporary Disability: When a worker needs time off to recover but will eventually return to work
  • Permanent Disability: For long-term injuries that reduce earning ability
  • Medical Expenses: Hospital bills, medication, rehabilitation, and transport to medical appointments
  • Death Benefits: A pension or lump sum paid to the worker’s dependents

How to Claim from the Compensation Fund

Here’s what the claim process generally looks like:

  1. Notify Your Employer: Inform them of the injury or illness as soon as possible.
  2. Employer Submission: They’ll submit a W.CL.2 form to the Compensation Commissioner.
  3. Medical Assessment: You need to visit a doctor who will complete the required medical reports (W.CL.4 and W.CL.5).
  4. Progress Tracking: Your employer and doctor will continue submitting updates to the Commissioner.
  5. Claim Approval: Once all documents are in order, the Compensation Fund then processes the claim.
